Terms and Conditions - Trainees

These terms and conditions apply to all bookings for training services made on the St Andrews Skills Academy website and in making a booking, the Trainee (as defined below) agrees to be bound by them.

  1. DEFINITIONS

    In these terms and conditions:-

    • “Booking Form”
      means the booking form completed by the Trainee and submitted [on-line or in hard copy] to St Andrews Skills Academy in respect of the Training;
    • “Training” means the training course booked by the Trainee details of which are set out in the Booking Form;
    • “Fee”
      means the fee payable (together with any VAT if applicable) by the Trainee for the Training as set out in the Booking Form and payable in accordance with condition 6 of these terms and conditions;
    • “Privacy Policy”
      means the privacy policy from time to time of St Andrews Skills Academy;
    • “Safety Rules”
      means the safety rules from time to time of St Andrews Skills Academy;
    • “St. Andrews Skills Academy”
      St. Andrews Skills Academy, PO Box 29254, 6 Bell Street, St Andrews, Fife KY16 6AB
    • “Trainee”
      means the person subscribing for the Training, his/her/its full name and address being set out in the Booking Form. In the event that the individual completing the Booking Form is an employee, he/she shall be deemed unless otherwise agreed, to be completing the Booking Form on behalf of his/her employer;
    • “Trainer”
      means the trainer or trainers to provide the Training;
    • “Training Date”
      means the date(s) for the provision of the Training set out in the Booking Form;
    • “Website”
      means the St Andrews Skills Academy website from time to time
  2. BOOKING FORM

    • 2.1 By submitting the Booking Form, the Trainee accepts these terms and conditions and undertakes, where appropriate, that he/she is authorised to submit the Booking Form on behalf of his/her employer or the person subscribing for the Training.
    • 2.2 The Booking Form shall be treated as an offer by the Trainee to contract with St Andrews Skills Academy for the Training Course on these terms and conditions and shall not be binding on St Andrews Skills Academy until such time as the Trainee has received written confirmation of acceptance on the Training Course.
  3. ST ANDREWS SKILLS ACADEMY’S RIGHTS, DUTIES AND OBLIGATIONS

    • 3.1 St Andrews Skills Academy is entitled to make changes to the Training (to include substitution of a specific Trainer for another Trainer) which do not materially change the content, performance, quality or value of the Training and shall give notice of such changes to the Trainee to as soon as reasonably practicable.
  4. TRAINEE’S RIGHTS, DUTIES AND OBLIGATIONS

    • 4.1 The Trainee will comply at all times with the Safety Rules and any additional reasonable directions and orders which may be given by St Andrews Skills Academy or by the Trainer at or before the Training Date.
    • 4.2 The Trainee shall, on giving not less than 5 working days notice to St Andrews Skills Academy, be entitled to nominate another individual to attend the Training in his/her place. In taking up the place of the Trainee, the nominated individual shall be bound by these terms and conditions in place of the Trainee and shall thereafter be the ‘Trainee’ for the purpose of these terms and conditions.
  5. CANCELLATION

    • 5.1 Following acceptance by St Andrews Skills Academy of a Booking Form, St Andrews Skills Academy shall be entitled to cancel the Training:-
      • 5.1.1 at any time up to the date falling 10 working days prior to the Training Date on giving to the Trainee a full refund of the Fee already paid (if any);
      • 5.1.2 at any time after the date given in condition 5.1.1 up to the Training Date without compensation or payment of any kind or refund of the Fee where cancellation is as result of the breach by the Trainee of these terms and conditions, terms and conditions applying to any other contract between the Trainee and St Andrews Skills Academy or of any other disciplinary matter;
      • 5.1.3 at any time after the date given in condition 5.1.1 up to the Training Date on, at St Andrews Skills Academy’s sole option, either (i) giving to the Trainee a full refund of the Fee already paid; or (ii) rearranging and rebooking the Training on another date or issuing the Trainee with a credit note for the Fee paid, such credit note to be used against booking of other training services at a future date.
    • 5.2 Following acceptance by St Andrews Skills Academy of the Booking Form, the Trainee shall only be entitled to a refund as follows:-
      • 5.2.1 in the event that written notice of cancellation by the Trainee is received by St Andrews Skills Academy not later than 10 working days prior to the Training Date, St Andrews Skills Academy shall give the Trainee a full refund of the Fee already paid (if any);
      • 5.2.2 in the event that written notice of cancellation by the Trainee is received by St Andrews Skills Academy less than 10 working days but 7 or more working days prior to the Training Date, St Andrews Skills Academy shall refund 75% of the Fee already paid (if any);
      • 5.2.3 in the event that written notice of cancellation by the Trainee is received by St Andrews Skills Academy less than 7 working days but 5 or more working days prior to the Training Date, a sum which is equal to 50% of the Fee already paid (if any); and
      • 5.2.4 in the event that written notice of cancellation by the Trainee is received by St Andrews Skills Academy less than 5 working days and 2 or more working days prior to the Training Date, a sum which is equal to 25% of the Fee already paid (if any).
    • 5.3 For the avoidance of doubt, in the event that written notice of cancellation by the Trainee is received by St Andrews Skills Academy less than 2 working days prior to the Training Date, the Trainee shall not be entitled to any refund and the Fee paid shall be forfeit.
  6. PRICES AND PAYMENT

    • 6.1 The Trainee shall pay the Fee set out in the Booking Form in full not less than 15 working days prior to the Training Date. In the event that the Training is to take place over a number of days, the Fee shall (unless otherwise agreed) be paid in full at least 15 working days prior to the first day of such Training. In the event of failure to pay the Fee timeously, interest at a rate of 2% above the base rate of HBOS plc from time to time shall accrue on the sum(s) remaining due from the date payable to the date paid in full. Without prejudice to its rights to interest, St Andrews Skills Academy shall be entitled to refuse the Trainee access to the Training or any other training provided by St Andrews Skills Academy until all sums due together with interest are settled in full.
  7. DATA PROTECTION AND PRIVACY

    • 7.1 The Trainee accepts that St Andrews Skills Academy may use the Trainees personal data in accordance with the Privacy Policy.
  8. GENERAL

    • 8.1 If any of these terms and conditions is held to be invalid, unlawful or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining terms and conditions shall not be affected.
    • 8.2 St Andrews Skills Academy may modify these terms and conditions at any time by publishing the modified terms and conditions on the Website. Any modifications shall take effect and shall be deemed accepted by the Trainee and applicable to the provision of the Training 5 working days after posting on the Website.
    • 8.3 St Andrews Skills Academy General Terms and Conditions regarding use of the Website. Where there is a conflict between these terms and the General Terms and Conditions, these terms and conditions shall prevail.
    • 8.4 These terms and conditions shall be governed by and construed under the Laws of Scotland and the parties submit to the non-exclusive jurisdiction of the Scottish courts.
    • 8.5 Any notice to be given pursuant to these terms and conditions shall be in writing and shall be served personally, faxed, emailed or sent by prepaid recorded delivery post to the address or number of the relevant party set out in the Booking Form. The notice shall be deemed to have been served as follows:
      • 8.5.1 if personally delivered, at the time of delivery; or
      • 8.5.2 if faxed, at the time shown on the fax delivery confirmation print out providing always that should the fax be sent after 3pm on a working day or on a day other than a working day, the fax shall be deemed to have been received at 9am on the next following working day; or
      • 8.5.3 if sent by email at the time shown on the ‘sent’ email print out providing always that should the email be sent after 3pm on a working day or on a day other than a working day, the email shall be deemed to have been received at 9am on the next following working day; or
      • 8.5.4 if sent by prepaid recorded delivery post, at the expiration of two business days after the same was delivered into the custody of the postal authorities.
